If you qualify for releases from jail, there are many ways this can occur. The first two ways are simply up to the judge based on a number of factors while the rest require some kind of payment.

If you have only committed a trivial crime, a judge may simple decide to hand you a citation detailing the charges as well as a schedule for court dates. Then, you will simply be released. In a first or minor offense for a person who has a job or other ties to the area, a judge may decide to let them go on their own recognizance. This means they are trusted to show up at their court sates without being pushed to do so.

If these two options are not given to you, then you will have to look at bail. Bail will be set by the judge based upon public safety, flight risk, and the seriousness of the offense. The first obvious option you have is to post bail with cash or cashier’s check. If you do not have the money upfront, you will need a bond. A bond is a way to pay a percentage of the bail as a guarantee for your appearance to court dates. You must go through a licensed bail bonds agency to do this.

A typical bail bond will be a fee of 10% bail and sometimes require monetary or property collateral. In this instance the bail bondsman is responsible for you appearing in court, and if you don’t, they may send a bounty hunter after you. In the case of a very large bail amount you may choose to do a property bond. In this instance the court will place a lien on your property for bond and foreclose on it if you do not show for scheduled court dates.
